1. PARTIES

This Agreement has been signed between the following parties under the terms and conditions specified below.

By accepting this Agreement, the BUYER acknowledges that upon confirming the order, they are obligated to pay the order amount along with any additional fees such as shipping and taxes, if applicable, and that they have been informed accordingly.

2. DEFINITIONS

In the implementation and interpretation of this Agreement, the following terms shall have the meanings set forth below:

  • MINISTER: Refers to the Minister of Customs and Trade.
  • MINISTRY: Refers to the Ministry of Customs and Trade.
  • LAW: Refers to the Consumer Protection Law No. 6502.
  • REGULATION: Refers to the Distance Contracts Regulation.
  • SERVICE: Refers to any consumer transaction other than the supply of goods provided or promised to be provided in exchange for a fee or benefit.
  • SELLER: Refers to the company that offers goods to consumers within the scope of its commercial or professional activities or acts on behalf of or for the account of the provider of such goods.
  • BUYER: Refers to the natural or legal person who acquires, uses, or benefits from a good or service for non-commercial or non-professional purposes.
  • SITE: Refers to the website owned by the SELLER.
  • ORDER PLACER: Refers to the natural or legal person who places an order for a good or service through the SELLER’s website.
  • PARTIES: Refers to the SELLER and the BUYER collectively.
  • AGREEMENT: Refers to this agreement concluded between the SELLER and the BUYER.
  • GOOD: Refers to movable property subject to shopping, as well as software, sound, video, and other intangible goods prepared for use in the electronic environment.

3. SUBJECT

This Agreement regulates the rights and obligations of the Parties regarding the sale and delivery of the product(s) specified below, which the BUYER has ordered electronically via the SELLER’s website, in accordance with the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation.

The listed prices on the site are the sales prices. The announced prices and commitments remain valid until they are updated or changed. Time-limited announced prices are valid until the specified period expires.

7. DETAILS OF THE PRODUCT(S) SUBJECT TO THE AGREEMENT

  1. The essential characteristics (type, quantity, brand/model, color, number) of the goods/services are published on the SELLER’s website. If a campaign has been organized by the SELLER, you can review the essential features of the relevant product during the campaign period. The campaign is valid until the announced date.
7.2. Prices

The listed prices on the site are the sales prices. The announced prices and commitments remain valid until they are updated or changed. Time-limited announced prices are valid until the specified period expires.

7.3. Taxes and Payments

The total price of the good(s) or service(s), including all taxes, is shown below:

9. GENERAL TERMS

9.1. Notification and Acceptance

The BUYER acknowledges, declares, and undertakes that they have read and understood the preliminary information about the essential characteristics, sales price, payment method, and delivery conditions of the product subject to the Agreement on the SELLER’s website and have given the necessary confirmation in the electronic environment.

9.2. Delivery Time

Each product covered by the Agreement shall be delivered within the period specified in the preliminary information section on the website, depending on the BUYER's location, provided that it does not exceed the legal period of 30 days.

10. RIGHT OF WITHDRAWAL

If the distance contract is related to the sale of goods, the BUYER has the right to withdraw from the contract within 14 days from the date of delivery of the product to themselves or a third party designated by them, without giving any reason and without incurring any penalty, by notifying the SELLER.

11. PRODUCTS EXCLUDED FROM THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply to products that are prepared according to the BUYER’s request or personal needs, such as underwear bottoms, cosmetics, disposable products, etc.

12. DEFAULT AND LEGAL CONSEQUENCES

If the BUYER defaults on payment transactions made by credit card, they agree, declare, and undertake that they will pay interest within the framework of their credit card agreement with their bank and that they will be liable to the bank.

13. COMPETENT COURT

In case of disputes arising from this Agreement, complaints and objections shall be submitted to the Consumer Arbitration Committee or the Consumer Court in the jurisdiction of the BUYER’s place of residence or where the consumer transaction took place.
